Austria lost its legal bid against the European Union's inclusion of nuclear energy and natural gas in the EU’s 2022 green taxonomy. Europe’s General Court upheld the European Commission's discretion, affirming that, under certain conditions, these energy sources may contribute to climate change mitigation and adaptation. The ruling highlights deep divisions within the EU about the role of transitional energy sources. While Austria—along with countries like Spain and Denmark—had argued that labelling fossil gas as green undermines climate objectives, others, including Poland and Bulgaria, supported its inclusion as a bridge away from high-polluting fuels like coal. The decision signals that the EU is maintaining a pragmatic approach to its sustainability taxonomy—allowing for context-based recognition of gas and nuclear in the clean transition. It may have long-term implications for energy investment flows, raising questions about the taxonomy's credibility in guiding truly low-carbon finance.
