The European Commission has proposed a major overhaul of EU public procurement rules, introducing a horizontal European preference framework alongside stronger requirements for quality, security, and supply-chain resilience. The proposed regulation would reshape procurement practices across a market representing around 15% of the European Union’s GDP, covering areas such as infrastructure, energy systems, and public transport.

A central change would give public buyers a clearer framework for determining access for third-country operators and products. Restrictions could be introduced where market-access assessments identify unfair treatment of EU operators or where measures are considered necessary to address security-of-supply dependencies and economic-security risks.

The proposal would also make the Best Price-Quality Ratio the standard approach for awarding contracts. Quality criteria would account for at least 30% of the assessment, rising to 50% for labor-intensive contracts under a comply-or-explain mechanism. Environmental, social, innovation, security, resilience, and European preference considerations could all form part of this quality assessment.

The reforms would consolidate existing procurement rules into a single regulation and reduce procurement procedures from five to three. They would also expand market consultation, introduce an innovation procedure, and create a connected digital procurement marketplace designed to simplify cross-border tendering.

Although the proposal is not yet law and must still be negotiated by the European Parliament and Council, businesses supplying public-sector markets should begin assessing its potential implications.
